Welcome to Synonym Magazine. These Terms of Use (“Terms”) are a legal agreement between you and Purpose/Symmetry, Inc., doing business as Synonym Magazine (“Synonym,” “we,” “us,” or “our”), governing your access to and use of synonym-mag.com, including all content, digital subscriptions, newsletter, and shop products offered through it (collectively, the “Site” or “Services”).
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must not access or use the Site.
1Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase a subscription or shop products, or to create an account. The Site is intended for a general audience and is not directed to children under 13.
2Description of Services
Synonym Magazine is an editorial publication offering articles, essays, and related content, along with:
- A free email newsletter, delivered via Mailchimp, to which you may subscribe
- Digital subscriptions to premium or member-only content, managed through Memberful
- A shop offering merchandise and other physical or digital products for purchase, powered by Shopify
We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice, and without liability to you.
3Accounts
3.1Subscription Accounts
If you purchase a digital subscription, you will create an account through Memberful. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information and to notify us promptly of any unauthorized use of your account.
3.2Newsletter Subscriptions
Subscribing to our newsletter requires only an email address (and optionally a name). You may unsubscribe at any time using the link provided in any newsletter email.
4Subscriptions, Billing, and Cancellation
- Recurring billing. Digital subscriptions may be offered on a recurring basis (e.g., monthly or annually) and will automatically renew at the then-current price unless you cancel before the renewal date.
- Payment processing. All subscription payments are processed by Memberful and its third-party payment processor. By subscribing, you authorize Memberful to charge your chosen payment method on a recurring basis until you cancel.
- Price changes. We reserve the right to change subscription pricing. We will provide reasonable advance notice of any price increase before it takes effect for existing subscribers.
- Cancellation. You may cancel your subscription at any time through your Memberful account management page. Cancellation will take effect at the end of your current billing period; we do not provide prorated refunds for partial billing periods except as required by law or as we may otherwise decide in our discretion.
- Refunds. Except as required by applicable law or as expressly stated at the time of purchase, subscription fees are non-refundable.
5Shop Orders
- Product information. We attempt to display product descriptions, images, and pricing accurately, but we do not warrant that product descriptions or other content on the Site are accurate, complete, current, or error-free. We reserve the right to correct errors and to cancel orders arising from such errors.
- Order acceptance. Your placement of an order through Shopify is an offer to purchase; we reserve the right to accept or decline any order for any reason, including product availability, errors in pricing or product information, or suspected fraud.
- Payment. All payments for shop orders are processed by Shopify and its integrated payment processors. By placing an order, you represent that you are authorized to use the payment method provided.
- Shipping. Shipping timeframes and costs are estimates and are not guaranteed. Risk of loss and title for products purchased pass to you upon delivery to the carrier.
- Taxes. You are responsible for any applicable sales, use, or similar taxes associated with your purchase, which will be calculated and collected at checkout where applicable.
6Intellectual Property
All content on the Site, including articles, essays, images, graphics, logos, the “Synonym Magazine” name and marks, and the design and organization of the Site (collectively, “Content”), is owned by Synonym or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Content for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any Content without our prior written consent, except as permitted by applicable law (such as fair use) or as enabled by standard sharing features we provide (e.g., social sharing links).
7User Conduct
When using the Site, you agree not to:
- Violate any applicable law or regulation
- Infringe the intellectual property or other rights of Synonym or any third party
- Attempt to gain unauthorized access to the Site, other users’ accounts, or our systems
- Use any automated means (bots, scrapers, etc.) to access or collect data from the Site without our prior written consent
- Interfere with or disrupt the operation of the Site or the servers or networks used to make it available
- Use the Site to transmit any harmful code, spam, or unlawful content
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
We reserve the right to suspend or terminate your access to the Site or your subscription account for violation of these Terms.
8Third-Party Services and Links
The Site relies on and may link to third-party services, including our hosting provider (Site5), content management system (WordPress), subscription platform (Memberful), shop platform (Shopify), and email platform (Mailchimp), as well as third-party payment processors and, occasionally, links to external websites. We do not control and are not responsible for the content, policies, or practices of any third-party service or website. Your use of third-party services may be subject to those parties’ own terms and privacy policies.
9Disclaimer of Warranties
THE SITE, CONTENT, AND ALL PRODUCTS AND SERVICES OFFERED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any errors will be corrected. Editorial content reflects the views of its authors and is provided for informational purposes; it does not constitute professional advice of any kind (including legal, financial, medical, or other advice), and you should not rely on it as such.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
10Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SYNONYM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR ANY PRODUCTS OR SERVICES OFFERED THROUGH IT.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SYNONYM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you.
11Indemnification
You agree to indemnify, defend, and hold harmless Synonym and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of a third party.
12Governing Law and Dispute Resolution
These Terms and any dispute arising out of or related to them or the Site shall be governed by the laws of the State of California, without regard to its conflict of laws principles, except to the extent that mandatory consumer protection laws of your country or state of residence provide otherwise and cannot be waived.
Any dispute arising out of or relating to these Terms or the Site shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts, except where applicable law requires otherwise.
13Changes to These Terms
We may revise these Terms from time to time. The most current version will always be posted on the Site with an updated “Last Updated” date. By continuing to access or use the Site after revisions become effective, you agree to be bound by the revised Terms. If we make material changes, we will provide reasonable notice, such as via the Site or email to subscribers.
14Termination
We may suspend or terminate your access to the Site, your subscription, or your account at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Site will immediately cease. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
15Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy and any additional terms applicable to specific Services (such as Memberful’s or Shopify’s own terms of service), constitute the entire agreement between you and Synonym regarding the Site.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
